Incapacity and misconduct: Distinct proceedings that must not be conflated
It is well established in South African labour law that incapacity proceedings are no-fault based, whereas misconduct proceedings are fault based. These processes entail different concepts and procedures, and an employer may not conflate the two. Freedom Day 2026: Basic education as the frontline of freedom
Freedom Day commemorates the attainment of democracy in 1994 and the constitutional order that followed. It also invites an ongoing assessment of whether the rights promised in the Constitution are being realised in practice. Among these, the right to basic education occupies a distinctive place.
