The coming into force of the Consumer Protection Act, No 68 of 2008 (CPA), in April 2011 not only dramatically changed the legal landscape for the conduct of business with consumers, but also in respect of marketing to consumers and for businesses involved in manufacturing consumer goods, even if those businesses don’t deal with end consumers.

The National Consumer Commission (NCC) has made it clear that it will vigorously pursue its mandate to protect consumers and bring to book businesses that don’t comply with the CPA. A good knowledge of the CPA and how to comply with its content are mandatory for consumer driven businesses.

Still getting spam calls? South Africa tightens Direct Marketing Regulations

South Africans, increasingly frustrated by unsolicited calls, should be experiencing meaningful relief following the Minister of Trade, Industry and Competition’s introduction of significant amendments to the Regulations under the Consumer Protection Act 68 of 2008. The Consumer Protection Act Amendment Regulations, 2026, published in the Government Gazette on 15 April 2026, are intended to provide stronger measures to regulate direct marketing practices, enhance consumer protection and reduce unwanted marketing communications.

The relationship between residential lease agreements and the Consumer Protection Act 68 of 2008 (CPA) often creates confusion, particularly when it comes to the termination of fixed-term lease agreements. The recent Supreme Court of Appeal (SCA) decision in Els v Venter and Another (449/2024) ZASCA 163 provides clarity on when the CPA applies and importantly, when it does not. The judgment considers whether a residential lease agreement concluded by private homeowners falls “within the ordinary course of business” as required by the CPA, and what this means for landlords and tenants in similar disputes.
