Tax amnesty countdown: Don’t miss the deadline
The Tax Procedures (Amendment) Act, 2024 extended the tax amnesty programme introduced by the Finance Act, 2023 by amending section 37E of the Tax Procedures Act to empower the Commissioner for Domestic Taxes to refrain from recovering penalties, interest or fines relating to tax debts, provided that the taxpayer settles all principal taxes for the periods up to 31 December 2023 on or before 30 June 2025.

In his opening of Parliament address on 18 July 2024, President Cyril Ramaphosa stated that the Government of National Unity will look to expand the basket of essential food items exempt from value-added tax (VAT) and undertake a comprehensive review of administered prices. Subsequently, politicians, members of Parliament, trade unions, the South African Poultry Association and the Red Meat Producers Organisation have all called for the expansion of the list of zero-ratedfoodstuffs.

The Social Health Insurance Fund (SHIF) was established by the Social Health Insurance Act, 2023 (Act). This, alongside the Primary Health Care Act, 2023 and the Digital Health Act, 2023 (the acts), were established to promote the right to affordable healthcare under the Constitution of Kenya, 2010 (Constitution). On 12 July 2024 the High Court declared some of the sections of the Act unconstitutional and gave Parliament 120 days to adhere to its orders, as discussed in our alert here .
