Our real estate team is advising Sasol Pension Fund, in its role as purchaser, in connection with the due diligence and acquisition process and drafting and negotiation of sale agreements in respect of two properties in Century City, Cape Town from the trustees for the time-being of the Century City Property Investment Trust and Century City Business Centre Property Trust, for the first property; and from the trustees for the time-being of Century City Property Investment Trust, for the second property. Jurisdiction in cross-border employment disputes: A clarification by the Labour Court
With some businesses and entities moving towards an increasingly globalised workforce, questions surrounding jurisdiction in labour disputes involving employees working abroad for domestic employers have become both complex and critical. South African labour law has, until recently, grappled with the issue of whether domestic dispute resolution forums, such as bargaining councils or the Commission for Conciliation, Mediation and Arbitration (CCMA), retain jurisdiction where an employee is domiciled or performs their duties abroad, but remains employed by a South African entity or entered into an employment agreement in South Africa, or through, a South African entity. The Labour Court provides important clarification in the case of Naidoo v Khosa NO and Others (JR1346/22) ZALCJHB 131.

In the matter of Raoul Gregor Wagner N.O v Johan Christian Gijsbers N.O and Three Others (20876/19) ZAWCHC 82 (5 June 2024), Mr Wagner (the applicant), in his capacity as the official receiver of Mr Jurgen Scheer’s insolvent estate in Austria, sought relief from the Western Cape High Court for recognition of his appointment as the trustee of Scheer’s Austrian insolvent estate in South Africa in order for him to remove any surplus funds after final distribution of Scheer’s South African insolvent estate from South Africa to Austria, for the benefit of Scheer’s Austrian creditors.
