Charles highlighted that transparent and fair tendering is a critical component of government processes. He noted that the public has a constitutional right, under the Promotion of Administrative Justice Act, to challenge procurement decisions.

Charles explained that, from a private sector perspective, one can approach the courts to review and potentially set aside a decision such as one made by SAPS, if it is deemed improper. From a government standpoint, these decisions have direct implications on public funds. If a contract is improperly awarded, the state may be obligated to pay a party that doesn’t deserve the contract.

In such cases, the law requires the state to initiate a self-review process to set aside its own decision, as procurement awards are binding unless legally overturned.
