AI gone rogue: Are employers liable when workplace AI harms employees?
When Anthropic released its Claude 4 evaluation report, a particular finding sparked significant discussion among artificial intelligence (AI) safety researchers: during testing scenarios, Claude Opus 4 blackmailed a human overseer to avoid deactivation. In another study, a recovering methamphetamine addict struggling with withdrawal and worried about losing his job as a taxi driver due to exhaustion was encouraged to take a “ small hit of meth ” to get through the week. As employers race to deploy AI platforms within their organisations, these findings raise an urgent question: If these events were real workplace incidents, who, if anyone, would be liable for any resultant harm?

Extend your lease before it is too late: An Analysis of the Supreme Court’s Decision in Harcharan Singh Sehmi and Another v Tarabana Company Limited and Five Others (Petition E033 of 2023)
In our experience, the most prudent approach is to apply for a lease extension at least five years before expiry. This rule of thumb exists for good reasons. In Kenya, there is a legal distinction between a lease extension and a lease renewal. An extension, if applied for before the lease expires, preserves the leaseholder’s legal interest and ensures continuity of title. Renewal, on the other hand, occurs after expiry, by which time the land has already escheated to the Government, the lessee’s rights have lapsed, and any new grant is subject to reallocation risks and fresh terms. When you factor in persistent delays at the land registry and the complications that can arise when life happens (such as the death of a co-tenant activating a procedural burden in the form of succession proceedings before any land dealings can occur), it becomes clear that waiting too long transforms a manageable administrative process into a precarious legal one.

Land Bank decisions clarify insurers’ governance obligations and powers of the Prudential Authority
Two recent decisions – a Financial Services Tribunal (Tribunal) ruling and a Gauteng High Court judgment – have clarified the Prudential Authority’s (PA) powers under the Financial Sector Regulation Act 9 of 2017 (FSRA), the transitional application of section 23(1)(a) of the Short-term Insurance Act 53 of 1998 (STIA), and governance obligations under the Insurance Act 18 of 2017 (Insurance Act). These cases arose from administrative penalties imposed on Land Bank Insurance Company SOC Limited (LBIC) and Land Bank Life Insurance Company SOC Limited (LBLIC) and provide important lessons for insurers on compliance and enforcementrisk.

Why private equity’s zombie companies persist and how to revive them
The world of private equity (PE) is often associated with aggressive investments and lucrative exits. Yet, beneath the veneer of high-octane deals lies a darker reality: a growing number of ‘zombie companies’ lingering in PE portfolios. These are businesses that are neither thriving nor dying, barely generating enough revenue to cover their debt servicing costs, and unable to invest in growth or innovation. The continued existence of these ‘half-alive’ creatures of the market, far from being benign, poses significant challenges for investors, the broader economy, and the companies themselves. Their slow, relentless stagger is not harmless background noise, as they sap energy and eat scarce capital in bite-sized chunks.
