Appealing or Rescinding? That is the question when dealing with judgments granted against a person without their knowledge

The Uniform Rules of Court direct that any document initiating legal proceedings must be served by the Sheriff of the High Court on a defendant/respondent. The purpose of this rule is to bring to the attention of the defendant/respondent that legal proceedings have been brought against them. The Uniform Rules of Court, however, do not always require the document instituting the legal proceedings to be personally served on the defendant/respondent. This can lead to a situation where judgment is granted against a person without their knowledge.

Rule 56, default cures and fairness: SCA confirms substance over procedure in tax disputes

In Commissioner for the South African Revenue Service v Virgin Mobile South Africa (Pty) Ltd ZASCA 77 (4 June 2025), the Supreme Court of Appeal (SCA) delivered important guidance on the procedural interplay between Rule 56 of the Tax Court Rules (Rules) and the requirement for condonation under Rule 52. This ruling provides important clarity on how late filings should be approached, particularly where the defaulting party acts within the grace period afforded under Rule 56.

Can an employee ever say that the right to discipline has prescribed?

As the law on prescription is relatively well settled, it is not a point an employer would expect to face as a defence in a disciplinary process. Also, there is a line of authority in the Labour Court which deals with the effect of the delays in disciplinary proceedings. The Labour Court was, however, recently called upon to consider this question in Public Investment Corporation v More and Others (J2121/22) (16 April 2025) and made it abundantly clear that disciplinary proceedings are not subject to prescription.

Recognition and enforcement of Russian Lugovoy Law judgments in South Africa

In June 2020 the Russian Federal Law 171-FZ was adopted (the “ Lugovoy Law ”). It amended Article 248 of the Russian Commercial (Arbitrazh) Procedure Code to enable Russian commercial courts to assume jurisdiction over disputes that involved sanctioned entities or are otherwise related to the imposition of sanctions. This amendment gave jurisdiction to Russian courts even where parties had contracted to resolve disputes before a foreign court or arbitral tribunal.
