Constitutional Court redefines parental leave: Key implications for employers and professionals
Our experts explain that the unanimous Constitutional Court ruling confirms that all parents are now entitled to a combined total of four months and ten days of parental leave per household, regardless of whether the child arrives through birth, adoption, or surrogacy. Parents will decide how to allocate this leave between themselves.
Previously, Anli, Lee, and Leila said that parental leave entitlements differed depending on the family arrangement; for example, birth mothers typically received four months’ maternity leave, while fathers or non-birthing parents received only ten days, and adoption or surrogacy arrangements had their own separate categories.
Our experts say that the judgment recognises that extending more leave to a birth mother effectively reinforces the assumption that women must be the primary caregivers.
The Court recognised that bonding and nurturing time is essential, and parental leave is now structured to support this need.
