Our real estate team is advising Sasol Pension Fund, in its role as purchaser, in connection with the due diligence and acquisition process and drafting and negotiation of sale agreements in respect of two properties in Century City, Cape Town from the trustees for the time-being of the Century City Property Investment Trust and Century City Business Centre Property Trust, for the first property; and from the trustees for the time-being of Century City Property Investment Trust, for the second property. Kenya’s tax outlook for 2024
Since coming into office in September 2022, the incumbent Kenyan Government has implemented policy measures aimed at steering economic recovery. As per the 2023 Budget Policy Statement and the Fourth Medium-Term Plan, it is currently targeting five key priority sectors. These sectors include agricultural transformation; the micro-, small- and medium-size enterprise economy; housing and settlement; healthcare; digital superhighway; and the creative industry. The Government is also redesigning taxation instruments to make them supportive of economic activity while boosting revenue collection. All these interventions have yielded progress, as the economy indicated an average growth rate of 5,6% in the first three quarters of 2023, up from 4,8% in 2022.

Deep dive into the Supreme Court’s decision in Symon Wairobi Gatuma v Kenya Breweries Limited
It is now well understood that any unilateral amendment to an employment contract amounts to an unfair labour practice under section 45 of the Employment Act 11 of 2007 (the Employment Act). This has recently been reiterated by the Supreme Court of Kenya in Symon Wairobi Gatuma v Kenya Breweries Limited and Three Others, Petition E023 of 2023 (the Supreme Courtdecision). The Supreme Court decision is, however, more than just a decision on unilateral amendments to employment contracts. It addresses and provides guidance as to how to treat employees during business restructuring exercises and redundancies.
