City of Cape Town: Establishment of a regional landfill site
Cliffe Dekker Hofmeyr advised the City of Cape Town on a challenge to the authorisation of the establishment of a regional landfill site.
This mandate is important as the City of Cape Town is running out of space in which to dispose of waste and it is critical that a new landfill site be established to ensure that adequate municipal services are supplied.

At it again: Capital v revenue
The capital versus revenue debate is as old as tax law itself. The benefits, advantages or consequences of an amount being considered capital or revenue in nature has motivated taxpayers and the South African Revenue Service (SARS) alike to characterise amounts as one or the other. More often than not, the task of distinguishing between the two has fallen to the courts, as it did once again in the case of A Taxpayer v Commissioner for the South African Revenue Service (IT45638) ZATC 13, where judgment was handed down on 19 July 2023 ( IT 45638 ).

Adjusting a definition
The circular reference error is a scourge that has plagued many tax practitioners’ spreadsheets since the amendment to section 20 of the Income Tax Act 58 of 1962 (ITA) at the end of 2021. This amended section 20 dictates that it can only be applied once all other sections of the ITA have been applied. However, a similar provision appears in the definition of “ adjusted taxable income ” in section 23M, the result being a conflict between the two sections and the question of which to apply first?

Can Real Estate Investment Trusts (REITs) be a pathway to affordable homeownership?
Kenya’s affordable housing agenda is a government initiative aimed at addressing the housing deficit in the country by providing affordable and decent housing for its citizens through homeownership. This initiative aligns with the Government’s broader development goals outlined in its Vision 2030 blueprint. The key challenges that have been identified as the barriers to delivering this agenda include (i) limited capacity for rapid construction of affordable homes even though the Government has initiated large-scale construction projects across the country; (ii) lack of guaranteed off-take, which undermines property developers’ confidence in exiting developments upon completion; and (iii) limited access to financing options that could enable developers bring more affordable homes to the market.
