City of Cape Town: Establishment of a regional landfill site
Cliffe Dekker Hofmeyr advised the City of Cape Town on a challenge to the authorisation of the establishment of a regional landfill site.
This mandate is important as the City of Cape Town is running out of space in which to dispose of waste and it is critical that a new landfill site be established to ensure that adequate municipal services are supplied.

High Court declares the power to issue income tax exemptions through a gazette notice unconstitutional
The High Court on 17 February 2023 declared section 13(2) of the Income Tax Act, which grants the Cabinet Secretary power to exempt certain income from tax, to be unconstitutional. This arose from a petition filed by Eliud Matindi, a public-interest litigant, against the Cabinet Secretary for National Treasury and Planning, the Attorney General, the National Assembly and the Kenya Revenue Authority.
