International Arbitration 2.0

On 13 April 2016 cabinet approved the draft International Arbitration Bill. On 28 April 2016 the Bill, together with its explanatory memorandum, was published in the Government Gazette. The International Arbitration Bill will shortly be introduced into Parliament.

The International Arbitration Act, as the Bill will be known once in force, will replace the 51 year old Arbitration Act, 1965 in respect of International Arbitrations. The most fundamental change that will be ushered in by the International Arbitration Act will be the incorporation of the UNCITRAL Model Law on International Commercial Arbitration into South African law. The Model Law, prepared under the auspices of the United Nations Commission on International Trade Law, is designed to assist States in reforming and modernizing their laws on arbitral procedure. It assists States to develop their arbitral procedure in step with the particular features and specific considerations at play in international commercial arbitration.

The International Arbitration Act will align South African International Arbitration Law with international best practice and should go a long way to establishing South Africa as a venue of choice for international arbitrations.

Elections 2024: Internet service providers must prevent dissemination of fake news

With the national and provincial elections less than two months away, the Film and Publication Board (FPB) published a notice on 22 March 2024 in which it defines the terms “ misinformation ” and “ disinformation ”, and declares them to be propaganda for war, inciting imminent violence or potentially advocating hate speech. The distribution of any such content via any medium, including social media, is an offence in terms of section 18H of the Films and Publications Act 65 of 1996 (Act). The fine, if found guilty, is R150,000 and/or a two-year prison term.

Freedom of expression in South Africa is guaranteed by the Bill of Rights. This includes, inter alia , freedom of speech, access to information, and, importantly, media freedom. The right to freedom of expression is fundamental and a prerequisite in any democracy. The post-1994 South African media landscape is turbulent and often somewhat adversarial. However, just like any other right enshrined in the Constitution, the right to freedom of expression may be limited where it is justifiable and reasonable. Even the media’s freedom may be constrained to protect another constitutional right or to preserve the integrity of the administration of justice.

The exercise of concurrent jurisdiction between competition authorities and sector-specific regulators has been a contentious topic, particularly where sector-specific pricing is at issue. However, in the case of Industrial Gas Users Association of South Africa v Sasol Gas (Proprietary) Limited and Others (IR095AUG22), and Sasol v Competition Commission and Others (OTH110SEP22) the Competition Tribunal (Tribunal) confirmed that the competition authorities are entitled to exercise their powers where there is concurrent jurisdiction, over alleged anticompetitive practices in regulated sectors.
