Commission refers case against auto body repairers

The Competition Commission has referred a case of price fixing, market division and collusive tendering against Eldan Auto Body CC (Eldan) and Precision & Sons Proprietary Limited (Precision). Eldan and Precision are both certified auto body repairers for Mercedes Benz and also do auto body repair to other makes of vehicles.

The referral follows an investigation by the Commission, which included a dawn raid at the offices of these firms (and one other) in July 2014. The Commission concluded that Eldan and Precision colluded from at least 2011 in respect of the provision of auto body repair services.

Cannabis in the workplace: Clearing the air

In 2018 the Constitutional Court handed down the landmark judgment of Minister of Justice and Constitutional Development and Others v Prince (6) SA 393 (CC), which legalised the private use and possession of cannabis. Concerns about the effect of the judgment in the workplace were ameliorated with an interpretation of the law, mostly in arbitration awards, which found that employers remain empowered to set workplace policies regulating substance abuse, including the use of cannabis. This position was recently confirmed in the 27 June 2023 Labour Court judgment of Marasi v Petroleum Oil and Gas Corporation of South Africa (C219/2020) ZALCCT 34.

On 24 March 2023, the Supreme Court of Appeal (SCA) handed down judgment dismissing an appeal brought by Strategic Partners Group (Pty) Ltd (SPG) against a judgment of the High Court in the matter of SPG and Others v Liquidators of Ilima Group (Pty) Ltd (in liquidation) and Others (Case no 1291/2021) ZASCA 27 (24 March 2023).
