Our Real Estate team advised these clients in the registration of various mortgage bonds and notarial general and special bonds. This mandate confirms the big-ticket nature of many of the real estate mandates handled by our experienced team as well as the trust placed in our team by public sector entities active in the real estate sector in South Africa.

High Court upholds the tax reality for Kenya’s private equity deal environment
Kenya’s High Court in ECP Kenya Limited v the Kenya Revenue Authority HCCOMMITA/E215/2023 has upheld a decision from the Tax Appeals Tribunal (the TAT) in ECP Kenya Limited v Commissioner of Domestic Taxes (Appeal 335 of 2022) KETAT 969 (KLR) (6 October 2023) (the Judgment), that will reshape discussions around how private equity (PE) funds will structure and exit investments in Kenya. Although the matter centred on whether gains from an offshore disposal could be taxed locally, the real significance lies in what the ruling signals for dealmaking confidence and investor expectations in Kenya, East Africa’s largest private-capital market.

Legal fees gone wild: A case of costs, controversy and common sense
The South African legal system witnessed a sobering showdown in the case of Sports Tavern & Restaurant and Others v Executor Estate Late Santos (HCAA 01/2023) ZALMPPHC 17 (5 February 2025), with arguments revolving around what constitutes “ reasonable legal fees ”. The matter centred on a bill of costs submitted by the appellants (Sports Tavern and Others), where a striking R20,000 was claimed as a day fee by an attorney in an unopposed Rule 30 application that became postponed.

Foreigners with pending waiver applications, visa applications and visa appeal applications safeguarded against adverse consequences until 30 September 2025
To the much-anticipated relief of many foreign nationals, on 28 March 2025, the Minister of Home Affairs, Dr Leon Schreiber extended the previous temporary blanket extension that expires today, 31 March 2025. The purpose of the latest extension is to address the visa, waiver and appeal outcomes that will not be ready for collection prior to the 31 March 2025 deadline due to amongst other things delays in the printing process. In addition, the extension would allow the Department of Home Affairs (DHA) an opportunity to focus on appeal outcomes, resultant from rejected visa applications.
