Extending the rules: Rethinking bid validity in municipal procurement
Charles noted that the management of bid validity periods in public procurement remains one of the most challenging aspects of supply chain management for South African municipalities. He explained that a series of Supreme Court of Appeal (SCA) judgments has significantly reshaped the legal landscape, and municipalities that fail to keep pace with these developments risk either undermining their own procurement processes or exposing themselves to costly and protracted litigation.
Charles further explained that bid validity, in the context of public procurement, refers to the period, typically 90 or 120 days from the closing date, during which a bidder’s offer remains open for acceptance by the procuring organ of state. According to Charles, this serves two key purposes: providing the procuring entity with sufficient time to evaluate, adjudicate, and award the tender, while also giving certainty to all participants regarding the timeframe within which their offer will remain valid and the process will be concluded.
