CDH bolsters its accomplished Dispute Resolution practice with key appointments

Cliffe Dekker Hofmeyr (CDH), a leading pan-African corporate and commercial law firm, is pleased to announce the appointment of two Directors Khaya Mantengu, who returns to CDH, and Sentebale Makara who both joined our esteemed Dispute Resolution practice in February 2024.

According to Rishaban Moodley, Head of CDH’s Dispute Resolution practice, “The local construction sector is facing strong headwinds which directly impacts investment in infrastructure projects, and overall construction activity. Moodley continues, “The appointment of Khaya to our construction and engineering sector, within our Dispute Resolution practice, underlines our commitment to providing quality and excellence in our service delivery to clients. “We also welcome Sentebale, a qualified mediator for the State of Missouri, who is well recognised for his client-centricity and specialised expertise in construction, engineering, mining, energy, and commercial litigation,” continues Moodley.

“Sentebale joins us with a deep understanding of clients’ challenges and expectations, and his ability to meet those needs effectively. His experience includes acting on behalf of well-established national and international companies in the construction, mining, renewable energy, and telecommunications space, including in relation to forensic investigations, disciplinary and other inquiries and disputes.”

CDH also welcomes two new associates, Zodwa Malinga and Dipuo Titipana to the Dispute Resolution practice. Zodwa offers a wealth of expertise in construction dispute resolution and commercial litigation. Dipuo’s specialisation in banking, insolvency, business rescue, Companies Act, and property-related disputes is complemented by a track record of successfully handling cases in various courts, representing esteemed corporate entities.

Arbitration: Careful drafting applies as much to the arbitration agreement as to the pleadings

An agreement to arbitrate a specific issue will generally describe both the issue the arbitrator is required to decide and the arbitrator’s powers. The arbitrator has no power beyond the agreed terms of reference. The parties will then usually set out their respective claims or defences in documents referred to as pleadings. Unless the terms of reference are broad, for example allowing the arbitrator to decide whatever issues arise from the pleadings, the arbitrator may be restricted by what is in the terms of reference. Even if the terms of reference are broadly to deal with any dispute that arises on the pleadings, anything not “ on the papers ” would seem to be excluded.

The soon to be ‘new’ preferential procurement framework

In addition to regulating public procurement generally, the long title to the Procurement Bill states that the Bill is meant to prescribe a framework within which preferential procurement must be implemented. Of course, this must be so, because the Constitution requires national legislation be enacted to provide for such a framework. It is important to note, however, that in as much as national legislation must prescribe a framework, the prerogative power to create and implement a preferential procurement policy within that framework remains with the individual organs of state and institutions. This was confirmed by the Constitutional Court, and is something that cannot be taken away from procuring entities by the Procurement Bill.
