The Labour Relations Amendment Bill, 2025 (2025 Bill), published on 26 February 2026, proposes changes to the remedies available to high-earning employees in unfair dismissal disputes. The Climate Change (Non-Market Approaches) Regulations, 2026 (Regulations) mark an important development in Kenya’s evolving climate change regulatory landscape. In recent years, climate policy discussions in Kenya have largely focused on carbon markets and the implementation of Article 6.2 and 6.4 of the Paris Agreement. Against this backdrop, the Regulations, which were gazetted on 12 February 2026, are particularly significant because they reflect a broader policy shift towards establishing a legal framework for non-market approaches (NMAs) to climate change in Kenya. The Regulations also operationalise Article 6.8 of the Paris Agreement, which encourages co-operation on climate action outside traditional carbon-credit trading systems.

From vine to verdict: Rule 46A execution against trust-owned farmland serving both commercial and residential purposes

When a borrower defaults on a loan secured by a mortgage bond over agricultural property, a lender’s instinct is to enforce its security. In practice, however, execution proceedings against immovable property have become considerably more complex since Rule 46A of the Uniform Rules of Court was introduced with effect from 22 December 2017. Rule 46A requires judicial oversight when an execution creditor seeks to execute against the residential immovable property of a judgment debtor, and was introduced to protect the right of access to adequate housing enshrined in section 26(1) of the Constitution. The historical background of Rule 46A may be traced to Jaftha v Schoeman and Others, Van Rooyen v Stoltz and Others ZACC 25, which concerned two indigent judgment debtors who were at risk of losing their only accommodation if the sales in execution of their homes were to proceed, and Gundwana v Steko Development CC & Others JOL 26971 (CC), which reaffirmed Jaftha and extended its purview to cases where a creditor seeks to execute against a property put up as security in the form of a mortgage bond.

Kenya VASP Act 2025: A new era for virtual asset regulation

The enactment of the Virtual Assets Service Providers Act, 2025 (VASPA), which came into force on 4 November 2025, marks a fresh start for both virtual asset service providers (VASPs) and investors. For years, the Central Bank of Kenya (CBK) maintained a cautious approach, issuing public notices in 2015 and 2020, warning against the use of virtual currencies due to their unregulated nature, lack of government backing, and high risk of fraud. Similarly, the Capital Markets Authority (CMA) raised concerns in 2018, cautioning about initial coin offerings, reflecting a firm institutional stance against virtualassets.
