12 May 2026 57:02 Minutes Webinar

CDH’s Dispute Resolution and Corporate & White Collar Investigations team hosted a webinar exploring the growing importance of forensic investigations in insolvency enquiries and corporate recovery proceedings. The session examined how forensic investigators uncover financial misconduct, trace asset dissipation, identify voidable and collusive transactions, and support creditor recoveries through evidence-driven investigations.

The webinar also unpacked the role of digital forensics, e-discovery and metadata analysis in strengthening insolvency enquiries, revealing document backdating, uncovering hidden communications and building compelling evidentiary cases. Attendees gained practical insights into insolvency enquiry processes, director accountability, litigation strategy and the legal remedies available under South African insolvency law.

Key takeaways from the webinar included:

  • Forensic investigations are essential, not peripheral, to effective insolvency practice
  • They transform raw financial data into actionable intelligence
  • Digital forensics and metadata analysis provide objective evidence that courts increasingly favor
  • Convergence of forensic evidence creates compelling, difficult-to-rebut cases
  • Practitioners armed with forensic evidence are better positioned to protect creditors and pursue claims
  • The insolvency process delivers accountability and recovery outcomes that creditors are entitled to expect
