Labour Court goes digital come 14 April

Lee Masuku, a Senior Associate in the Employment Law practice, was recently on Newzroom Afrika to discuss the digitalisation of the Labour Court, effective 14 April, and whether this will help reduce delays and what risks may arise.

Lee explained that what began as an online process for the filing of all urgent applications has now evolved to all court documents being filed electronically, and every matter before the Labour Court being initiated through the Court Online system.

This shift, Lee noted, aims to significantly reduce the administrative burden of managing physical documents. Parties can now expect a streamlined, end-to-end digital process for the filing of court documents.

Lee further explained how the system works: the party initiating the matter must upload the relevant documents, such as a signed notice of motion in an application and obtain a case number. Once this is done, all parties involved in the matter must be invited via the online platform to participate.

For unrepresented or lay litigants, support will be made available. Help desks will be stationed at the Labour Court to assist those unfamiliar with the online system. Additionally, a virtual help desk via Microsoft Teams will be available to guide users experiencing challenges with the platform.

Rethinking staff outsourcing contracts from a tax perspective

On 30 August 2024, the Tax Appeals Tribunal (Tribunal) delivered a judgment in Appeal E433 of 2024 (judgment), in which it held that the reimbursement of staff costs made by a charitable foundation (Foundation) to a non-charitable but related company (Related Co) under a staff secondment arrangement was subject to withholding tax (WHT) since the costs amounted to management or professional fees. This marks a departure from its earlier decision in Two Lakes Packaging Services Limited v Commissioner of Domestic Taxes (Appeal Number 420 of 2021) (Two Lakes), in which the Tribunal held that WHT should not be deducted from recharges of staff salaries.

Foreigners with pending waiver applications, visa applications and visa appeal applications safeguarded against adverse consequences until 30 September 2025

To the much-anticipated relief of many foreign nationals, on 28 March 2025, the Minister of Home Affairs, Dr Leon Schreiber extended the previous temporary blanket extension that expires today, 31 March 2025. The purpose of the latest extension is to address the visa, waiver and appeal outcomes that will not be ready for collection prior to the 31 March 2025 deadline due to amongst other things delays in the printing process. In addition, the extension would allow the Department of Home Affairs (DHA) an opportunity to focus on appeal outcomes, resultant from rejected visa applications.
