The ripple effects of South Africa’s cannabis food ban: Implications for agriculture and beyond

On 28 May 2024, the President signed the Cannabis for Private Purposes Act 7 of 2024 (Cannabis Act) into law. The Cannabis Act establishes a legal framework for the private use, possession and cultivation of cannabis in South Africa. However, the act still imposes significant restrictions on the legal cultivation and commercial trade of cannabis. Conversely, hemp, as defined below, has been extensively cultivated for commercial purposes in South Africa and other African countries for several years now. NERSA’s decision on Eskom’s curtailment application pending

In terms of a consultation paper released by the National Energy Regulator of South Africa (NERSA) on 5 July 2024 (Consultation Paper), Eskom submitted an application to NERSA on 24 May 2024 requesting approval for congestion curtailment to be treated as a constrained generation ancillary service for renewable energy resources (Application). Per the Consultation Paper, “ leveraging the intermittent nature of renewable energy resources, it becomes possible to connect more resources to the grid without exceeding the capacity of the grid for most of the time ”.

The legal implications of defamation claims arising from disciplinary investigations were brought into focus in the recent case of Ndobe v Gibela Rail Consortium RF (Pty) Ltd ZAGPJHC 1215 (27 November 2024) ( Gibela ). This case examined whether an employer could be held liable for defamation when an investigation report implicated an employee in project mismanagement. The judgment provides valuable insights into the boundaries of employer liability and the principles safeguarding confidentiality and fairness in suchproceedings.
