Cabinet Secretary approval required before loan interest rate adjustments: Clarification by the Supreme Court
The Central Bank of Kenya (CBK) is reviewing its current risk-based credit pricing model. This model involves banks setting their lending rates based on the CBK’s base rate and a borrower’s risk profile, rather than applying a uniform interest rate. Borrowers with a higher risk profile get higher interest rates on their loans. This model has, however, led to some banks overcharging their clients and imposing additional fees that exceed the true underlying risk. As a result, CBK is proposing to introduce a new model where all loan interest rates will be tied to the Central Bank Rate plus a clear, bank-specific margin that will be published 30 days before any change.

The relationship between residential lease agreements and the Consumer Protection Act 68 of 2008 (CPA) often creates confusion, particularly when it comes to the termination of fixed-term lease agreements. The recent Supreme Court of Appeal (SCA) decision in Els v Venter and Another (449/2024) ZASCA 163 provides clarity on when the CPA applies and importantly, when it does not. The judgment considers whether a residential lease agreement concluded by private homeowners falls “within the ordinary course of business” as required by the CPA, and what this means for landlords and tenants in similar disputes.

The Central Bank of Kenya’s expanded net over non-deposit taking credit providers
On 27 December 2024, the Business Laws (Amendment) Act 20 of 2024 amended section 33S of the Central Bank of Kenya Act, CAP 491, Laws of Kenya (CBK Act) replacing the term “digital credit business” with “non-deposit taking credit business” . The amendment had the effect of removing the separate requirement for digital credit providers licensing and expanding the Central Bank of Kenya’s (CBK) oversight over credit business more generally and without emphasis on the form of channel used to advance a loan. Recent privacy updates in South Africa and abroad
South Africa is experiencing a sharp increase in reported data breaches. The Information Regulator (Regulator) noted 2,374 breaches in the 2024/25 financial year, an average of 198 per month. Since April 2025, 1,947 breaches have been reported, about 284 per month, which constitutes a 40% increase.
