What is the legislation that governs companies in Namibia?

The primary statute governing companies in Namibia is the Companies Act 28 of 2004 (Companies Act), together with its regulations. The Companies Act is administered by the Registrar of Companies within the Business and Intellectual Property Authority (BIPA), established under the Business and Intellectual Property Authority Act 8 of 2016.

The Public Enterprises Governance Act 1 of 2019, together with the Companies Act, regulates state-owned companies.

The State Finance Act 31 of 1991, together with the Companies Act, regulates the receipt, custody, banking, accounting, control and disposal of funds of state-owned companies.
