Clarice began her legal career at a law firm in Kenya and in 2010 she joined Carbon Africa as a Legal and Trading Officer. In 2014, Clarice was a Principal Consultant at Stawiri, and later joined Kieti as a Partner in 2017.

Energy

  • Supporting the development and drafting of Kenya’s Draft Energy (Mini-Grid) Regulations, 2021 on behalf of the Energy and Petroleum Regulatory Authority (EPRA).
  • Advising on captive solar regulatory compliance in relation to the acquisition of operational (small scale embedded) solar PV plants in Kenya.
  • Advising community owners in a 7.8 MW small hydropower project in Central Kenya on corporate entity set up, corporate governance requirements, and conflict resolution guidelines.
  • Advising corporate entities in the mini-grid sector on setting up in Kenya and aiding in obtaining requisite permits and licenses to enable company operations.
  • Reviewing Kenya’s Solar Water Heating Regulatory Framework for an Energy Regulatory Commission Study on Kenya’s solar water heating industry.
  • Carrying out a comparative study on net metering laws in different countries and drafting Kenya’s net metering draft regulations, under a consultancy on renewable energy regulatory capacity development commissioned by the European Union (EU) Energy Initiative Partnership Dialogue Facility, in support of Kenya’s Ministry of Energy.
  • Providing energy sector law and policy analysis in the Development of the Turkana County Energy Sector Plan on behalf of the Turkana County Government.
  • Conducting legal analysis on the concessionary energy retailing model for mini-grid integration in Kenya.

Climate Change

  • Carrying out a Legal and Policy review for a Green Finance: Market Readiness and Stakeholder Research in Mozambique Study for FSD Mozambique.
  • Carrying out a feasibility study on the establishment of the East Africa Community (EAC) Carbon Credit Exchange Mechanism.
  • Drafting subsidiary legislation under the Climate Change Act, 2016, on behalf of the Ministry of Environment and Forestry and the Climate Change Directorate, on Duties for Public and Private Entities, Monitoring, Reporting and Verification (MRV), and Penalties and Incentives.
  • Carrying out an assessment of legal title on emission reductions for Internationally Transferred Mitigation Outcomes (ITMO) transfers under Article 6 of the Paris Agreement, and advising on legal capability of the Government of Kenya to transfer the title of emission reductions to another government.
  • Developing the Office of the United Nations High Commissioner for Human Rights (OHCHR)-United Nations Framework Convention on Climate Change (UNFCCC)- Paris Committee on Capacity Building (PCCB), online course on Human rights and Climate change.
  • Advising on carbon consultancy agreements for the provision of carbon asset development and management assistance for a 310 MW and 51 MW wind, small hydro, geothermal and biogas projects in Kenya; small scale renewable energy projects structured as a Programme of Activities (PoA) under the CDM in South Africa; and cook stove and solar lantern distribution projects in rural East Africa.
  • Undertaking a legal review on carbon pricing in Sub-Saharan Africa for Konrad Adenauer Stiftung.
  • Providing climate finance advisory services to develop Climate Smart Agriculture projects on behalf of the National Environment Trust Fund (NETFUND) under the AfDB funded Kenya Green Economy support programme.
  • Carrying out a capacity-building mapping study for private sector climate action in Eastern and Southern Africa, for the International Development Research Centre of Canada (IDRC) and the capacity -building team at the UNFCCC Secretariat.
  • Advising project developers on Emission Reduction Purchase Agreements (ERPAs) for carbon projects developed in Kenya.
  • Providing training and capacity building on climate change and carbon contracting in Kenya and Uganda.

Chemicals and Waste

  • Carrying out a regulatory due diligence of Kenya’s waste sector for private sector engagement and a review of cross-border investing under the UNDP-funded Waste Sector Technical, Legal and Financial Readiness for Private Sector Engagement Project (Kenya).
  • Advising the Kenya Association of Manufacturers on best practices for extended producer responsibility schemes and the creation of an enabling legal and regulatory environment to manage post-consumer plastic packaging waste in Kenya.
  • Part of a team of researchers carrying out a scoping study on the sources and impacts of multiple chemical pollution on Kenya’s Lake Victoria and select tributaries feeding into the Lake and evaluating governance responses to address the pollution.

Water

  • Advising an international climate change advisory and investment firm on the Kenyan law context for the design and implementation of a pilot water Payment for Ecosystem Services Scheme (PES).
  • Advising a real estate management company on the collection of water payments in a mixed used development involving the provision of both privately supplied and publicly supplied water.
  • Advising an international climate change advisory and investment firm on mechanisms for industrial water efficiency in Kenya and legal issues surrounding water supply and distribution, water and sanitation, and water resource management.

 Fisheries, Forestry and Biodiversity

  • Advising an international climate change advisory and investment firm on REDD+ in Kenya, the policy and legal framework for forest management and conservation and providing input on the government-initiated review process of the National Forest Policy, 2014 and the Forest Conservation and Management Act, 2016.
  • Advising a commercial farm forestry organization on the legal context for carbon rights ownership and transfer in Kenya.
  • Drafting forest produce agreement

Gender and Human Rights

  • Carrying out a gendered review of financial sector policies and laws in Kenya for FSD Kenya.
  • Providing legal and institutional analysis expertise on a Kenya Human Rights Commission study on the human rights consciousness of Environmental and Social Impact Assessments (ESIAs) conducted in Kenya.
  • Part of a team of researchers carrying out a UNDP-funded study on the blue economy, gender, and coastal fisheries in Kenya in the context of the COVID-19 Pandemic.
  • Carrying out an analytical study and preparing a report on the integration of human rights in National Biodiversity Strategies and Action Plans (NBSAPs), in support of the Office of the United Nations High Commissioner for Human Rights (OHCHR) work on biodiversity.
  • Carrying out a study on gender, pastoralism, and climate change with a focus on Isiolo and Marsabit Counties, for the development of a toolkit on gender integration in climate change work withinpastoral communities for the Pan African Climate Justice.
