In 2017 the Pro Bono and Human Rights Practice has taken great strides. In what has been an inspiring and rewarding year, we have assisted many of our clients resolve long, arduous legal battles, with great positive impact, made significant progress in furthering the causes of others, partnered in exciting and innovative human rights initiatives, hosted high profile guests, and assisted other Practice areas in carrying out important and meaningful pro bono work.

In recognition of our contribution and those of others in the Firm who have given generously of their time and expertise, we are proud to report that the Firm won three awards during the 2017 year for its pro bono contributions and in so doing has cemented its reputation as one of the leading contributors to pro bono amongst law firms across the country. The decriminalisation of cannabis use and/or possession for minors: A significant shift in South African drug law reform

In 2019, the Constitutional Court in Minister of Justice and Constitutional Development and Others v Prince and Others (1) SA 14 (CC), partially confirmed the judgment in Prince v Minister of Justice and Others (4) SA 299 (WCC), which declared provisions of the Drugs and Drug Trafficking Act 140 of 1992 (Drugs Act) and the Medicines and Related Substances Act 101 of 1965 unconstitutional. In doing so, the Constitutional Court decriminalised the use, possession and cultivation of cannabis by adults for their personal use in private.

The SCA reconfirms the restrictions of a court where a substitution order is sought in administrative decisions

In The Municipal Manager: The City of Johannesburg Metropolitan Municipality and Others v San Ridge Heights Rental Property (Pty) Ltd (517/2022) ZASCA 109 the Supreme Court of Appeal (SCA) was confronted with a case in which the owner of a property exhausted all internal remedies before launching a review application; the review application was launched timeously; and even after the launch of an internal appeal, the City of Johannesburg (Municipality) had failed to file reasons for its decisions. In this article, we will explore the principles established by the SCA and their broader implications.
