In November 2015, the National Assembly passed the Taxation Laws Amendment Bill which, among other changes, introduced forced annuitization of benefits accruing to provident fund members on retirement. While the ink on these recent pension reforms is barely dry, we have been informed to expect further and substantial developments in this particular area of law in the next few days and weeks. We also have it on good authority that other reforms in pension law will come to the fore soon.

To reiterate, we will keep you up to date about any and all developments, and endeavour to explain what these developments mean for you and your business.

Elections 2024: Internet service providers must prevent dissemination of fake news

With the national and provincial elections less than two months away, the Film and Publication Board (FPB) published a notice on 22 March 2024 in which it defines the terms “ misinformation ” and “ disinformation ”, and declares them to be propaganda for war, inciting imminent violence or potentially advocating hate speech. The distribution of any such content via any medium, including social media, is an offence in terms of section 18H of the Films and Publications Act 65 of 1996 (Act). The fine, if found guilty, is R150,000 and/or a two-year prison term.

Welcome announcement for foreign nationals in possession of a Zimbabwean or Lesotho Exemption Permit

On 1 December 2023, Dr Aaron Motsoaledi, the Minister of Home Affairs (Minister), announced his decision to grant an exemption to Zimbabwean and Lesotho foreign nationals who are in possession of either a Zimbabwean Exemption Permit (ZEP) or Lesotho Exemption Permit (LEP). This exemption has been granted in terms of section 31(2)(b) of the Immigration Act 13 of 2002 (Act) which empowers the Minister to grant inter alia a category of foreigners the rights of permanent residence for a specified, or unspecified period, upon the existence of special circumstances which would justify such decision.

The decriminalisation of cannabis use and/or possession for minors: A significant shift in South African drug law reform

In 2019, the Constitutional Court in Minister of Justice and Constitutional Development and Others v Prince and Others (1) SA 14 (CC), partially confirmed the judgment in Prince v Minister of Justice and Others (4) SA 299 (WCC), which declared provisions of the Drugs and Drug Trafficking Act 140 of 1992 (Drugs Act) and the Medicines and Related Substances Act 101 of 1965 unconstitutional. In doing so, the Constitutional Court decriminalised the use, possession and cultivation of cannabis by adults for their personal use in private.
