Our latest global thought leadership report, Whistleblowing: an employer's guide to global compliance, is based on a unique multi-jurisdictional research project on the highly topical subject of whistleblowing.

Whistleblowing is attracting high-profile worldwide media attention, from the Bradley Manning and Edward Snowden affairs to the investigation of global companies by the Chinese authorities - multinational employers need to be alive to the potential for whistleblowing issues.

Intelligence and market analysis from 10 countries – including South Africa – have been included in the report which provides a summary of the key legislative provisions regulating whistleblowing but also examines the reasons for some of the key differences between the legal regimes.

Developments in anti-bullying measures in South Africa: Possible jail time for bullies

South Africa is a country plagued by bullying and associated child-on-child abuse. Despite there being five separate pieces of legislation aimed at preventing and addressing bullying among minors in and outside of school, educational institutions, parents, and teachers are still struggling to grapple with the complex nature of bullying. Renewable energy tax incentives to be re-energised

Section 12B of the ITA deals with, amongst other things, renewable energy tax incentives. It assists companies investing in renewable energy assets with cash flow constraints through an accelerated capital depreciation allowance on qualifying assets and supporting infrastructure. Given South Africa’s critical energy shortage and the global move to a greener energy mix, this tax incentive is a cornerstone of South Africa’s current fiscal policy.

Missed opportunities: The implications of squandering a disciplinary hearing

In employer-employee workplace tales, a person decrying unfair termination is a common scenario. But what about the instances where the employee had a chance to tell their side of the story in a disciplinary hearing, but they let it slip away? This is the story in the case of Okun v Kenyatta University (Cause 363 of 2019) where the employee sought a declaration from the court that his employment was terminated unfairly. The twist is that the employer had extended two invitations to the employee to appear before a disciplinary committee, which were postponed at the request of the employee. Thereafter, it sent a third invitation which the employee refused to honour entirely. What is the implication of squandering the termination process in thisway?
