Trusts and non-resident beneficiaries: 2023 TLAB proposal a step too far?

The conduit-pipe principle in the context of trusts has long been part of South African law. In essence, it states that income earned by a trust can flow through to the trust beneficiaries, pursuant to vesting of such income by the trust. The amount vested will retain its nature and will be subject to tax in the hands of the beneficiary, if the amount is vested in the beneficiary before the end of the year of assessment.

Court orders removal of livestock from South African farm

In a recent judgment from the Land Claims Court in Moladora Trust v Mereki and Others (189/2023) ZASCA 37 (3 April 2024) , the Moladora Trust’s (Trust) appeal was upheld, resulting in a significant ruling regarding the presence of grazing animals on a farm in the North West Province. The Trust, as the owner of the property, had sought relief against the Mereki children, who were occupying the land and grazing livestock without explicit consent.

Can the Pension Fund Adjudicator ignore a response to a disputed death benefit?

An employee who is a member of a retirement fund would have a death benefit that is payable to their dependents when they pass away. Importantly, the benefit does not form part of the deceased member’s estate and is not subject to deceased estate processes. The trustees of the fund are responsible for allocating the death benefit under section 37C of the Pension Funds Act 24 of 1956 (Act).

Know your limitations: Lessons from English case law on limitations of liability

Managing risk and allocating liability forms the focal (and sticking) point of many agreements, whether transactional (e.g. a sale) or relationship-based (e.g. a services agreement). A limitation of liability clause may be used to limit a party’s liability in numerous ways, whether by time, amount or nature. Not only should a limitation of liability be carefully negotiated – it should also be carefully worded to ensure its interpretation aligns with the parties’ agreed principles. The English case of Drax Energy Solutions Limited v Wipro Limited EWHC 1342 (TCC) highlighted the importance of the wording used in a limitation of liability. The similarities between the rules of interpretation in England and South Africa allow significant lessons to be gleaned from the case.
