Don’t go banking on review

The ability to review our revenue service’s decisions in the High Court is a question that has plagued South Africa’s legal system since the amendment of section 105 of the Tax Administration Act 28 of 2011 (TAA). Now the highly anticipated decision of the Supreme Court of Appeal (SCA) in Commissioner, SARS v Absa Bank Ltd and Another ZASCA 125 (29 September 2023) ( Absa ), dealing with just this issue, has been handed down. In The Municipal Manager: The City of Johannesburg Metropolitan Municipality and Others v San Ridge Heights Rental Property (Pty) Ltd (517/2022) ZASCA 109 the Supreme Court of Appeal (SCA) was confronted with a case in which the owner of a property exhausted all internal remedies before launching a review application; the review application was launched timeously; and even after the launch of an internal appeal, the City of Johannesburg (Municipality) had failed to file reasons for its decisions. In this article, we will explore the principles established by the SCA and their broader implications.

Two recent English Commercial Court decisions serve as a warning to dishonest parties hoping to exploit the arbitral process to obtain or enforce fraudulent or corrupt arbitration awards. The English courts generally follow a non-interventionist approach when it comes to the challenge of enforcement of arbitral awards. However, these recent decisions signify that the Commercial Court can and will use its statutory powers to intervene, investigate and order disclosure to uphold the legitimacy of the arbitral process and parties’rights.
