Transparency and co-operation should be the first steps in resolving real estate disputes

On 9 December 2024, the Supreme Court of Appeal (SCA) handed down judgment in The Body Corporate of San Sydney v Shivani Singh and Others (779/2023) ZASCA 169 (9 December 2024) in terms of which the order of the KwaZulu-Natal Division of the High Court, Durban was set aside and substituted with an order directing the respondents to sign whatever consent was required for the body corporate to obtain a certificate of real right in respect of the extension of the San Sydney Sectional Title scheme by the addition of three buildings that had been erected on the common property of the scheme, and to it exercising that right itself. Furthermore, should the respondents fail to sign such consent in whatever format required by the Registrar of Deeds, the Sheriff of the High Court was authorised and directed to sign the written consents on behalf of the respondents

It is well known that one of the benefits of business rescue is that it provides breathing room for the company in financial distress through the temporary moratorium on the rights of claimants against the company. The creditors of a company in business rescue are usually found scrambling to determine what their rights are in the event of a debtor going into business rescue. Business rescue affords the business rescue practitioner certain powers when it comes to contracts in general, which means that any party that has contractual relations with the company may have its rights affected by the exercise of such powers. Therefore, it does not mean that if one is not a creditor of the company, they will not be affected by the business rescue.

Jurisdiction in cross-border employment disputes: A clarification by the Labour Court

With some businesses and entities moving towards an increasingly globalised workforce, questions surrounding jurisdiction in labour disputes involving employees working abroad for domestic employers have become both complex and critical. South African labour law has, until recently, grappled with the issue of whether domestic dispute resolution forums, such as bargaining councils or the Commission for Conciliation, Mediation and Arbitration (CCMA), retain jurisdiction where an employee is domiciled or performs their duties abroad, but remains employed by a South African entity or entered into an employment agreement in South Africa, or through, a South African entity. The Labour Court provides important clarification in the case of Naidoo v Khosa NO and Others (JR1346/22) ZALCJHB 131.
