The decriminalisation of cannabis use and/or possession for minors: A significant shift in South African drug law reform

In 2019, the Constitutional Court in Minister of Justice and Constitutional Development and Others v Prince and Others (1) SA 14 (CC), partially confirmed the judgment in Prince v Minister of Justice and Others (4) SA 299 (WCC), which declared provisions of the Drugs and Drug Trafficking Act 140 of 1992 (Drugs Act) and the Medicines and Related Substances Act 101 of 1965 unconstitutional. In doing so, the Constitutional Court decriminalised the use, possession and cultivation of cannabis by adults for their personal use in private.

Sealing the loopholes? An analysis of the Affordable Housing Bill, 2023

The High Court of Kenya, in its decision of 28 November 2023 in Okiya Omtatah Okoiti and 51 Others V The Cabinet Secretary for the National Treasury and Planning and 6 Others , Constitutional Petition No. E181 of 2023 (Consolidated), held that the housing levy as framed in Finance Act, 2023 (Finance Act) was unconstitutional. Consequently, the Government gazetted the Affordable Housing Bill, 2023 (Bill) on 7 December 2023 as an attempt to cure the issues that were raised by the High Court in its decision. This alert analyses the Bill vis-à-vis the issues that were identified by the HighCourt.

One step closer to law: The Copyright Amendment Bill and Performers’ Protection Amendment Bill

On 29 February 2024, both houses of the National Assembly approved these two controversial bills and sent them to the President for assent. The drafters of the Copyright Amendment Bill (CAB) stated that it is aimed at updating the Copyright Act 98 of 1978 (Copyright Act) to make it more effective for educators, researchers, and people with disabilities and also to ensure that artists “ do not die as paupers due to ineffective protection ”. This latter aspect is also addressed by the Performers’ Protection Amendment Bill (PPAB) which states that it seeks to protect performers’ moral and economic rights, as well as the rights of producers of soundrecordings.

Acquisitive prescription of property: Is it still applicable in cases where there has been illegality?

Dhanwanthie Gianchandi (the possessor), along with her late husband, purchased a house three houses away from the property in April 1990. The property was undeveloped and deserted and the possessor and her family made improvements to the property, transforming it into a functional nursery and community park. The possessor had been running the nursery and park at her own cost since 1990. At the time the possessor’s application was brought, the improvements made to the property amounted to approximately R950,000 and the possessor also absorbed the park’s running costs of R16,000 per month.
