Kenya enacts the Conflict of Interest Act, 2025: What businesses need to know
The Conflict of Interest Act 11 of 2025 (the Act) was assented to on 30 July 2025 and came into
force on 19 August 2025, repealing the Public Officer Ethics Act. The Act establishes a robust
framework for preventing, identifying and addressing conflicts of interest in the public service. It
redefines the boundaries between public duty and private interest, introduces stricter prohibitions,
and grants wider enforcement powers to the Ethics and Anti-Corruption Commission (the EACC). While
designed to regulate public officers, the Act’s provisions have direct and far-reaching implications
for businesses that supply goods and services to Government, participate in public procurement,
engage in public-private partnerships, or hire former public officials.
