Our projects & energy team is advising this client in its role as buyer; transmission company; distributor; and system operator on the Renewable Energy IPP Procurement Programme. This mandate is wide-ranging and include advising on the appropriate regulatory regime and governance issues, power purchase agreements, procurement of IPPs, technical issues and agreements on grid interconnection and respective renewable energy technologies. In addition, we are also advising on a range of contract and claims management for Eskom for all of the 64 renewable energy projects under the programme, as well as the resolution of disputes and all ancillary processes contemplated under the project documents. A further 27 projects are anticipated to be signed in the first quarter of 2018.

What constitutes “special circumstances” in an application to the Supreme Court of Appeal, for special leave to appeal

Section 17(3) read with section 16(1)(b) of the Superior Courts Act 10 of 2013 provides for an application for special leave to appeal to the Supreme Court of Appeal (SCA). According to the SCA, special circumstances may arise if the appeal deals with a substantial point of law, or the matter is of great importance to the parties or the public, or where the prospects of success on appeal are so strong that the refusal to grant leave to appeal would result in a denial of justice for the party seeking leave to appeal.
