Our team advised Sinopec Group in its bid for Chevron Global Energy Inc's refining and retail assets in South Africa and Botswana.
Cliffe Dekker Hofmeyr represented Sinopec Group, China’s largest manufacturer and supplier of petroleum and petrochemical products and an entity which was ranked third in the Fortune Global 500 in 2017.
Our competition team advised this client in its bid for Chevron Global Energy Inc's refining and retail assets in South Africa and Botswana. The merger attracted considerable attention given the strategic importance of the refining assets. As a result, the Sinopec was required to negotiate a comprehensive set of undertakings with the Minister of Economic Development aimed at ensuring that the merger served the public interest.

Reflecting on Human Rights Day and Freedom Day: The Cases of Omotoso and Cwecwe

On 27 April, we celebrate Freedom Day to commemorate our first post-apartheid elections and to celebrate our constitutional dispensation. SARS v PAJA: The saga continues
Beginning most prominently with the original hearing of ABSA Bank Limited v Commissioner, SARS (3) SA 513 (GP) in the High Court (which we previously discussed here ), a taxpayer’s right to approach the High Court to request the administrative review of SARS’ decisions has been a bone of contention between SARS and taxpayers. Although the ABSA case was put to bed by the Constitutional Court earlier this year (it was consolidated with four other cases in United Manganese of Kalahari Proprietary Limited v Commissioner, SARS and Four Other Cases (5) BCLR 530 (CC)), the most recent case to reach the High Court in this saga between SARS and taxpayers came in the form of Kerbyn Cape 2 Proprietary Limited v Commissioner, SARS (15899/2023) ZAWCHC 308.

Types of alternative dispute resolution
Alternative dispute resolution (ADR) methods have become the preferred mechanism to resolve commercial disputes. The traditional approach to dispute resolution used to be litigation. The popularity of alternative methods of dispute resolution can in part be attributed to the backlogs experienced by courts. This has also resulted in the incorporation of one of the alternative dispute resolution methods into the Uniform Rules of Court. The introduction of the new Rule 41A in March 2020 meant that an initiator of litigation proceedings was required to file a notice asking the other party whether they were amenable to mediation and the other party was required to respond with its own notice, but mediation was by agreement. Recently, the Gauteng Division of the High Court issued a directive introducing mandatory mediation in the Gauteng division and the accompanying protocol.
