Businesses must align with Amended Employment Equity (EE) Act to secure state contracts
The Department of Employment and Labour has confirmed that EE Certificates of Compliance, required for businesses seeking state contracts, will be valid for 12 months. Issued under the amended Employment Equity Act, the certificate confirms compliance with targets, reporting obligations, and non-discrimination laws. Deputy Director Advocate Masilo Lefika emphasised that non-compliance may lead to contract rejection or cancellation. Two new EE regulations were published on 15 April 2025, and from 1 September 2025, all EE reports must align with the updated law. Employers must ensure they meet all criteria to obtain and retain their certificate.
