Sadia says the proposed POPIA amendments are quite significant, aiming to strengthen the rights of data subjects and make compliance more practical for businesses.

She explains that one of the key updates involves clearer definitions. Terms such as complainant, complaint, and in writing have been clarified to remove ambiguity when individuals submit complaints or forms, whether to businesses or the Information Regulator.

Secondly, Sadia says that the objection process has been simplified. Individuals can now object to the processing of their personal data free of charge and through various communication channels such as telephone, WhatsApp, or SMS. If a telephone objection is made, the call must be recorded. The process for correcting or deleting personal information has also been updated. For example, if a telemarketer uses WhatsApp, SMS, or a phone call to reach out, consent must now be properly recorded, transcribed, and documented.

Finally, Sadia notes that the Regulator can now offer payment plans for administrative fines, making it easier for businesses to comply.

Sadia says that while the amendments are not yet in force, individuals should begin familiarising themselves with their rights and the updated processes.
