The Central Bank of Kenya’s expanded net over non-deposit taking credit providers

On 27 December 2024, the Business Laws (Amendment) Act 20 of 2024 amended section 33S of the Central Bank of Kenya Act, CAP 491, Laws of Kenya (CBK Act) replacing the term “digital credit business” with “non-deposit taking credit business” . The amendment had the effect of removing the separate requirement for digital credit providers licensing and expanding the Central Bank of Kenya’s (CBK) oversight over credit business more generally and without emphasis on the form of channel used to advance a loan. We highlighted this and the other amendments in an alert published earlier this year here .

South Africa is experiencing a sharp increase in reported data breaches. The Information Regulator (Regulator) noted 2,374 breaches in the 2024/25 financial year, an average of 198 per month.
