CDH's Finance & Banking practice advised Nedbank, RMB and Futuregrowth in relation to the provision of ZAR1,3 billion funding to Enyuka Prop Holdings for the purposes of the repurchase of all shares previously held by Emira Property Fund Limited in Enyuka Prop Holdings and the refinancing of certain existing debt.
Our Finance & Banking practice advised Nedbank Limited (acting through its Nedbank Corporate and Investment Banking division), FirstRand Bank Limited (acting through its Rand Merchant Bank division) and Futuregrowth Asset Management Proprietary Limited (acting in its capacity as agent for and on behalf of its clients) in relation to its provision of funding to Enyuka Prop Holdings Proprietary Limited for the purposes of, amongst others, the repurchase of all of the shares previously held by Emira Property Fund Limited in Enyuka Prop Holdings Proprietary Limited and the refinancing of certain existing debt.

Announcement: Effective date of Employment Equity Act Amendments
On 14 April 2023, President Cyril Ramaphosa signed the Employment Equity Amendment Act 4 of 2022 into law, amending the Employment Equity Act 55 of 1998. Although no effective date has yet been proclaimed, there are unverified reports suggesting implementation may begin in January 2025. This cannot be confirmed at this time, and we will keep you informed of any official developments.

Capacity building and fostering expertise in international arbitration in Africa
The central theme of the Johannesburg Arbitration Week 2024 (JAW) was showcasing arbitration in Africa. This prompted engaging discussion and renewed calls for the Africanisation of international arbitration. This encompasses African disputes being arbitrated in Africa, presided over by African arbitrators, administered by African arbitral institutions, and argued by African lawyers. With expanding foreign direct investment in Africa and the expansion of BRICS to Egypt and Ethiopia, the calls to ensure that Africa has a voice in and imprint on the international arbitration proceedings it participates in are gathering momentum. This ensures that Africa’s unique priorities and experiences are sufficiently taken intoconsideration.
