Margo started her career at Fasken as a Candidate Attorney in 2013 where she was appointed as an Associate in 2015 and promoted to Senior Associate in 2018. Margo joined Cliffe Dekker Hofmeyr as a Senior Associate in 2020 in the Corporate & Commercial practice. Margo was appointed Director in 2021.

Margo has extensive experience in respect of environmental and regulatory considerations particularly in Project Finance transactions in respect of energy and infrastructure development; the application of the Equator Principles; climate change developments, litigation and considerations; ESG; green-hydrogen opportunities; extended producer responsibility;  administrative appeals and reviews; environmental compliance audits; and general environmental advisory in the mining; agriculture; cement manufacturing; food and beverage manufacturing and pharmaceutical industries.  

Specific experience includes: 

  • Advising a number of bidders in relation to their respective bid submissions in the Renewable Energy Independent Power Producer Procurement Programme (Round 5) and Risk Mitigation Independent Power Producer Programme (RMIPPP), including project development considerations around environmental permitting and securing of access to water; attending to bid preparation; and drafting the environmental legal opinion required by the qualification criteria of the RMIPPP RFP
  •  Advising renewable energy developers in respect of wind farm wakeloss considerations
  • Drafting a settlement agreement between a renewable energy developer and neighbouring landowner to prevent further and future challenges to the proposed project
  • Advising the lenders and conducting the regulatory and environmental due diligence investigations in respect of a number of projects in the Renewable Energy Independent Power Producer Procurement Programme (Round 4), including what is considered to be the largest single renewable energy financing in Africa
  • Advising an international energy developer in its successful selection as a preferred bidder in the Coal Baseload Independent Power Producer Procurement Programme for the development of a proposed thermal coal-fired power station which would use circulating fluidized-bed technology and be fuelled by discard coal
  • Advising an international energy developer on the provision of solar photovoltaic energy to a major beverage manufacturer
  • Advising the lender on the funding of approximately 25 projects that encompass various technologies (including solar photovoltaic, refrigeration and steam facilities) to be undertaken by a solar power generation manufacturer and operator for a number of different off-takers, including major retailers and food manufacturers
  • Advising an international beverage manufacturer and  a Producer Responsibility Organisation in respect of the development of Extended Producer Responsibility regulations in South Africa
  • Advising an American chemicals manufacturer in respect of the registration of a military grade chemical detergent to assist in the combat of Covid-19
  • Assisting SANParks, the leading South African conservation agency with environmental audits of mines located in national parks
  • Running an opposition to an appeal against a client’s provisional atmospheric emissions licence, including the drafting of submissions and heads of argument, with the outcome of the appeal being a success for client as the appeal was dismissed
  • Running an opposition to an appeal against a client’s integrated water use licence through the Water
  • Tribunal, including the drafting of submissions and heads of argument
  • Assisting a client with a successful application to the Minister of Human Settlements, Water and Sanitation for the upliftment of the suspension of its integrated water use licence
  • Climate change considerations including: carbon regulation and trading; regulatory compliance and enforcement; environmental risk management; sustainability management; resource and environmental policy development and implementation and climate change litigation
  • Advising a client in the cement manufacturing industry on a complicated question in respect of the use of alternate fuels as a fuel input and drafting submissions to the licencing authority
  • Advising a client on the reporting obligations in respect of a potential environmental emergency incident;
  • Electricity Regulation including experience with the various IPP Programmes (Renewable and Coal Baseload), NERSA Objections and application of the Grid Code and advice on regulatory considerations for the installation of a new technology of electricity generation
  • Financial Provisioning required for prospecting and mining rights
  • Environmental Due Diligence Investigations
  • Environmental and Regulatory compliance audits and assessments
  • Commercial Drafting, including: environmental and regulatory related clauses and provisions in finance agreements; sale of property and lease agreements;  transferring and apportioning of environmental liability
  • Advising on liability of licence holders, shareholders, directors, land users and other parties for environmental pollution and / or degradation
  •  Waste Management.
