Fatima  Ameer-Mia is a Director in our Technology, Media & Telecommunications practice. She specialises in commercial matters and transactions with a technology or intellectual property related focus - such as software development, licensing, outsourcing, the commercialization of intellectual property and a wide range of managed services. Her expertise extends to fintech, health-tech, insure-tech and data protection across a diverse range of industry sectors, especially financial services, retail and healthcare. She also has a special interest in the fields of cybercrime, information security and artificial intelligence.

Fatima began her legal career as a Candidate Attorney at Webber Wentzel in Johannesburg. She was admitted as an Attorney in 2012 and practiced as an Associate for three years. Fatima joined Cliffe Dekker Hofmeyr (Cape Town) in 2015 where she was appointed as a Senior Associate. Fatima was promoted to Director in 2019.

  • Fatima specialises in commercial law, with a focus on information technology, intellectual property, telecommunications and data protection law. She also has a special interest in matters relating to cybercrime, information security and artificial intelligence.
  • Fatima has extensive experience and regularly advises clients, both local and international, on general commercial matters and transactions with a technology or intellectual property related focus - such as software development, licensing, outsourcing, the commercialization of intellectual property and wide range of managed services. Her expertise extends to fintech, health-tech, insure-tech and data protection across a diverse range of industry sectors, especially financial services, retail and healthcare
  • Fatima has advised clients (both local and international) on complex aspects of privacy law, including advising on the Protection of Personal Information Act and GDPR, and jurisdictional assessments advising on data protection legislation in Africa, Europe, Latin America and the UAE. She has a special interest in the field of cybercrime and information security and has provided training and reporting on the Cybercrime and Cybersecurity Bill.

  • Advising municipal entity on IP-address block range squatting, managing data protection compliance project for national blood service collection, advising a hospital group on its international intra-group data transfers, advising SA bank on roll out of artificial intelligence project; advising hospital group on precision medicine and genomics technology project, advising and hosting workshops with major hospitals and medical scheme providers on data protection issues for the establishment of the first SA national health information exchange and related technology agreements, advising on ICT outsourcing and ERP implementation project for a public body, advising international in-flight retailer in respect of product supply and services with airlines, advising international film production company with regards to IP chain of title for a novel to be turned into a film and drafting agreements relating to obtaining exchange control approval for the IP arrangement, and advising SA bank on agreements relating to development, implementation and support a new payment gateway.

2018 notable transactions:

  • Advising software vendor on licensing and royalty arrangements and transfer of IP to an offshore structure; advising pension fund administrator on agreements relating to implementation of new pension fund administration system; advising major insurer in respect of IT outsourcing transactions, advising IT company on a staged and managed transitional exit from a large insurer; designing a regulatory and compliance framework for a SA bank in respect of its data protection and information security (including in respect of EU data protection legislation); advising international in-flight retailer on intellectual property issues relating to a payment system and contractual relationships with logistic suppliers; advising a film production company on its agreements relating to casting, equipment leasing, and other intellectual property related issues and conducting an anti-bribery and corruption risk assessment and designing compliance risk management programmes for key pieces of legislation for a top retailer.
