Kyle Bowles is an Associate in our Dispute Resolution practice. He is a member of the construction litigation team focusing on construction and engineering law, general commercial litigation, insurance and banking litigation, and alternative dispute resolution. 

Kyle, as part of a greater team, has experience in multi-million-rand arbitrations, adjudications and court actions and applications. He also has experience in commercial drafting, in particular in respect of construction and mining contracts.

Contentious Experience

  • Representing a client in dispute proceedings relating to the construction of a pipeline at a wastewater treatment plant.
  • Representing employer in dispute proceedings relating to construction of power plant.
  • Representing contractor in dispute with sub-contractor regarding construction of road infrastructure.
  • Various commercial high court actions and applications (including urgent applications) on behalf of inter alia banks, insurers, consulting engineers, couriers and construction companies, including:
    • General commercial matters relating to supply of goods agreements and supply of technology services.
    • Urgent application relating water supply at Sandton Gautrain Station.
    • Constitutional challenge relating section 2B of the Wills Act.
    • Claims against various companies and financial advisors relating to restraints of trade.
  • Advising on various administrative law matters relating to requests in terms of the Promotion of Access to Information Act.
  • Advising client in respect of SABS / SANS compliance issues.

Non-contentious Experience

  • Assisting a client in drafting a construction contract for the construction of a gas pipeline in Ghana.
  • Drafting particular conditions to JBCC, FIDIC silver book, mining contracts and bespoke construction contracts.
  • Advising client on various aspects relating to IPP agreements.
  • Drafting of commercial agreements on behalf of various companies.
  • Advising client on notification of claim for business interruption under primary assets all risks insurance policy.
  • Advising underwriter on possible prescription issues relating to notification of claim under insurance policy.
  • Conducting review and providing advice to underwriter in respect of contractor’s plant and equipment all risk policy.
  • Assisting client in negations for the renewal of service contracts with the Department of Home Affairs.
