Insolvency and Business Rescue

  • Advising creditors and financial institutions in insolvency proceedings:
  • Commencement of liquidation proceedings either by means of a voluntary process or by way of court proceedings and drafting the necessary resolutions and ancillary documents or application to court depending on the nature of the instruction;
  • Submission of claims in an insolvent estate;
  • Attendance at meetings of creditors; and
  • Convening and conducting enquiries in terms of the Companies Act and Insolvency Act into the trade, dealings and affairs of the insolvent company;

Business rescue proceedings:

  • institution of business rescue proceedings; and
  • opposing business rescue proceedings, where appropriate;
  • Assisting in litigation associated with the liquidation of companies, sequestration of individuals or business rescue proceedings;
  • Perfection of rights under General Notarial Bonds.


Commercial recoveries;

  • Ensuring compliance in recovery proceedings with Companies legislation and the National Credit Act;
  • Debt recovery proceedings by summons or application;
  • Settlement negotiations and drafting repayment agreements.
