Andrew Heiberg


Andrew Heiberg is a Director in our Real Estate practice. He specializes in both commercial and residential property transfers and developments as well as commercial property finance transactions. Andrew has been involved in the establishment of several residential and commercial property developments and is currently involved in a residential development, called the Rondebosch Oval, which is unique in that it is established around a cricket oval, where balancing the rights and obligations of the developer, the cricket club and the future owners of properties within the development was paramount, especially when it came to the drafting the Home Owners Association Constitution.

In addition to dealing with all aspects of conveyancing, Andrew specializes in sectional title transactions, deceased estate property transfers and share-block related work. One of his recent successes was opening a new sectional title scheme called The Curragh, which was the first scheme handled by our practice requiring the approval of the CSOS ombud. He managed to secure the necessary CSOS certificate in record time and despite many other construction challenges, managed to register the scheme on the last day of the deeds office year in 2016, saving the developer significant holding costs.

Andrew prides himself on providing a personal service to his clients and on regular and comprehensive updates on the various matters under his supervision.

Andrew began his career as a Candidate Attorney at Silberbauers in 1992. In 1994 he was appointed as an Associate and in 1998 as a Director. Silberbauers joined the practice of Cliffe Dekker Fuller Moore (now Cliffe Dekker Hofmeyr) in 1999 where Andrew remained a Director.


  • Acting on behalf of Rabie Properties, Andrew handled the Lakeview property development in Retreat, Cape Town including the establishment of the Township register, the transfer of approximately 600 units to end-purchasers in various phases and the establishment and registration of several Sectional Title Schemes within this development.
  • Assisted the Malherbe Group of companies with various residential developments in the Fish Hoek and Glencairn areas, as well as commercial sectional title property developments in Epping and Somerset West.
  • Advised Classico Developments on the acquisition of land for property development culminating in the establishment of four security village developments and three Sectional Title schemes.

Real Estate

  • Assisted and advised Glenfas Pt Ltd, Komdev Pty Ltd and Timbertruss Pty Ltd in the sectionalisation of their commercial property holdings and the disposal of individual units to end purchasers.
  • Assisted and advised Chartaprops Pty Ltd in the disposal of their entire commercial property rental portfolio.
  • Assisted and advised PDP Projects on the acquisition of a development opportunity in Kenilworth culminating in a 14 unit Sectional Title Scheme;
  • He continues to advise Rawson Properties on the structuring of a development in Rondebosch which will culminate in a 41 erven residential development called the Rondebosch Oval.
  • Handled the conveyancing aspects relating to the sale and transfer of properties in the Zevenwacht Country Estate;
  • Continues to advise the developer and to register transfers in the Wedderwill Country Estate residential development.
  • Continues to advise the Malherbe Family Trust in respect of the establishment and extension of Sectional Title Schemes in Cape St Francis resort;
  • Continues to advise Best Brands Pty Ltd and Bespoke Kings Property Developments CC in respect of various commercial and residential property developments.
  • Advised on and supervised the sale and transfer of a rental enterprise property portfolio for Panache Properties Pty Ltd and Shabros Investments Pty Ltd

Commercial Property Finance

  • Assisted a domestic company in the acquisition and registration of development finance in respect of a commercial venture in the Cape Town business district – R90 million.
  • Andrew is the Director in charge of all bond registration work for Grindrod Bank and for Nedbank Home-loans.
