The prohibition or restriction of prospecting or mining within the buffer zone of the Mapungubwe World Heritage Site

The Minister of Mineral Resources has in the Government Gazette, No 38004 of 12 September 2014, in terms of s49(1) of the Mineral and Petroleum Resources Development Act, No 28 of 2002 (as amended), having regard to the national interest to protect the sensitive environment of areas within the buffer zone of the Mapungubwe World Heritage Site, issued a notice of his intention:

  • to restrict the granting of any mining right to the extent that the mining action, activity or process concerned must first be modified in such a manner that there shall be no physical impact whatsoever on the surface of the land; and
  • that no further applications for prospecting rights or mining permits will be granted in respect of the following farms in the Limpopo Province –

Any stakeholder, interested and affected parties may submit written representations by 13 October 2014 (30 days from date of notice) to the Minister on the proposed prohibition or restrictions, addressed to the Regional Manager, Limpopo Region, Department of Mineral Resources.

The impact of the fluctuation of the Kenyan currency with regards to investment in Kenya

The Kenyan shilling dropped significantly in value (by approximately 22%) against the US dollar between March 2022 and January 2024. During this period there was a continuous drop in value with the lowest rate being KES 160.80 per dollar in January 2024. Various factors have been attributed to the depreciation of the shilling against the dollar, including the COVID-19 pandemic, which affected the global economy; rapid monetary policy tightening by the US Federal Reserve; the Russia-Ukraine war and the subsequent sanctions against Russia which disrupted supply chains; drought; and the Kenyan Government’s heavy debt burden, which reduced Kenya’s reserves below the required level of not less than the value of four months’ worth of imports. In February 2024, the shilling gained against the dollar from KES 160 to KES 145 and, as at 6 March, the shilling stands at 142.8 against the dollar. It is not certain whether this upward trend will continue or if future declines/fluctuations are to be expected. In this article, we discuss the actions taken by the Government to mitigate this, look at the impact of fluctuation of the Kenyan currency on investments, and propose somesolutions.      Mitigation measures by the Government

Cannabis in the workplace: Clearing the air

In 2018 the Constitutional Court handed down the landmark judgment of Minister of Justice and Constitutional Development and Others v Prince (6) SA 393 (CC), which legalised the private use and possession of cannabis. Concerns about the effect of the judgment in the workplace were ameliorated with an interpretation of the law, mostly in arbitration awards, which found that employers remain empowered to set workplace policies regulating substance abuse, including the use of cannabis. This position was recently confirmed in the 27 June 2023 Labour Court judgment of Marasi v Petroleum Oil and Gas Corporation of South Africa (C219/2020) ZALCCT 34.

Arbitration: Careful drafting applies as much to the arbitration agreement as to the pleadings

An agreement to arbitrate a specific issue will generally describe both the issue the arbitrator is required to decide and the arbitrator’s powers. The arbitrator has no power beyond the agreed terms of reference. The parties will then usually set out their respective claims or defences in documents referred to as pleadings. Unless the terms of reference are broad, for example allowing the arbitrator to decide whatever issues arise from the pleadings, the arbitrator may be restricted by what is in the terms of reference. Even if the terms of reference are broadly to deal with any dispute that arises on the pleadings, anything not “ on the papers ” would seem to be excluded.
